1. Controller

Sodji Sanvi · Lern Up Academy

Email: info@lernupacademy.de

2. General information on data processing

We only process personal data to the extent necessary to provide a functioning website and our content and services. The legal bases are in particular Art. 6(1)(a), (b) and (f) GDPR.

3. Visiting the website (server logs)

When you visit our website, the hosting provider automatically collects information (e.g. IP address, date and time of access, page visited, browser type). This data is used for the technical provision and security of the website (Art. 6(1)(f) GDPR) and is deleted after a short time.

This website is hosted by Cloudflare Pages (Cloudflare, Inc.). A data processing agreement is in place with the provider.

4. Contact form & email contact

If you contact us via the short form (it opens WhatsApp), via WhatsApp or by email, your details (name, phone number or email address, message) are stored to handle your enquiry. The legal basis is Art. 6(1)(b) or (f) GDPR. The data is deleted as soon as it is no longer required for the purpose of processing.

WhatsApp: If you contact us via the WhatsApp button, the message is prepared in your WhatsApp app and only transmitted to us when you send it. The privacy policy of WhatsApp (Meta Platforms Ireland Ltd.) applies. Alternatively, you can always reach us by email or phone.

5. Lern Up Coach (AI practice partner)

The Lern Up Coach is a talking AI practice partner. It states at the beginning of every conversation that it is an AI (Art. 50 AI Act). It is not a teacher.

What is processed: the spoken word (converted into text in real time) or, in chat mode, the typed messages, the conversation transcripts as text, the first name and the school year or language level you mention, as well as your learning progress (words practised, strengths and weaknesses, short observations) and answers on worksheets. Voice recordings are not stored.

Service providers: Speech recognition, speech output and conversation control are provided by ElevenLabs (Eleven Labs Inc., USA). The responses are generated by a language model from Anthropic (Anthropic PBC, USA), which ElevenLabs uses on our behalf. We store learning progress, worksheets and access data with Cloudflare (Cloudflare, Inc.). For transfers to the USA, we rely on the EU-US Data Privacy Framework or on EU standard contractual clauses.

Uploading homework and learning material: During a conversation, you can upload a photo or PDF, e.g. of your homework or a text you are working on. The file is sent to ElevenLabs and read by the language model (Anthropic) so that the coach can go through the tasks with you. The coach transfers the tasks into a worksheet as text. Please only photograph the tasks or text, not names, addresses or faces. We delete uploaded files together with the conversation transcripts at ElevenLabs.

Quiz and feedback after the session: At the end of a session, the coach creates a short quiz and written feedback (what was practised, strengths, weaknesses and practice tips). We send the feedback with the link to the quiz by email to the address you signed up with – for children under 16, that is the parents’ address. The emails are sent via Resend (see section 6). We store the quiz, quiz result and feedback with Cloudflare as part of your learning progress. The feedback is created by an AI and labelled as such in the email.

Legal basis: Art. 6(1)(b) GDPR (provision of the practice service). For children under 16, we only use the coach with the consent of the parents (Art. 6(1)(a), Art. 8 GDPR), which can be withdrawn at any time.

Minute balance: To calculate the minutes used from your plan, we store the start, duration, subject or language and the associated conversation ID for each conversation. We retrieve the duration from ElevenLabs for this purpose.

Storage period: Learning progress remains stored as long as access exists and is deleted immediately on request thereafter. We regularly delete conversation transcripts at ElevenLabs. We delete the minute balance data no later than three years after the end of the contract.

6. Sign-up by email and free trial

For the trial and access to the coach, you sign up with your email address. We send you a six-digit code that is valid for 10 minutes. After confirmation, you remain signed in on this device for 30 days; a random sign-in key is stored in your browser’s local storage for this purpose. You can sign out at any time.

What is processed: email address, time of sign-up and trial, whether access has been activated and, to prevent misuse, the IP address (for a maximum of 2 days) and the internet connection used (shortened for IPv6 addresses), so that the free trial can only be used once (30 days). For children under 16, we ask for the parents’ email address.

Device identifier for the free trial: So that the free 5-minute trial can only be used once per device, we store a randomly generated identifier in your browser when the trial starts (local storage, IndexedDB and a cookie “lu_g”). On our server we only store a non-reversible check value (hash) of it, and no other characteristics of your device. The identifier is deleted after 180 days. The legal basis for storage in the browser is § 25(2) no. 2 TDDDG (strictly necessary for the trial you requested), and for processing Art. 6(1)(f) GDPR (protection against misuse of the free trial).

Sending the codes: via Resend (USA). The emails are sent via a data centre in Ireland; Resend stores sending logs in the USA (EU-US Data Privacy Framework or standard contractual clauses).

Legal basis: Art. 6(1)(b) GDPR (sign-up and access) and Art. 6(1)(f) GDPR (protection against misuse of the free trial).

Information about offers: Only if you tick the box will we occasionally send you information about our offers (Art. 6(1)(a) GDPR). You can withdraw your consent at any time by email to info@lernupacademy.de.

Storage period: codes after 10 minutes, sign-ins after 30 days. We delete your email address as soon as you request it or when there is no longer any access or consent.

7. Payment and contracts

You pay for coach plans via the payment service provider Stripe (Stripe Payments Europe Ltd., 1 Grand Canal Street Lower, Dublin 2, Ireland). Stripe processes your name, email address, payment data (e.g. card or account details), billing country, amount, time and technical data for fraud prevention (e.g. IP address, device information). If you choose PayPal, you are redirected to PayPal (PayPal (Europe) S.à r.l. et Cie, S.C.A., 22–24 Boulevard Royal, L-2449 Luxembourg), which processes the payment under its own responsibility. If you choose Klarna, Stripe transmits your name, email address, billing country, amount and order data to Klarna (Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden). Klarna processes the payment under its own responsibility and may carry out an identity and credit check for this purpose, including with the help of credit agencies. Further details can be found in Klarna’s privacy notice at klarna.com. We do not receive card details; we only see whether and how payment was made.

For your contract, we store the email address, the chosen plan, term, payment status, cancellations and a customer and subscription ID from Stripe. On the English website, we may also use the billing country to check that the offer is only used by customers in the EU.

Legal basis: Art. 6(1)(b) GDPR (performance of contract), Art. 6(1)(c) GDPR (retention obligations under tax and commercial law) and Art. 6(1)(f) GDPR (fraud prevention).

Storage period: We retain invoices and payment receipts for ten years in accordance with § 147 AO and § 257 HGB, and other contract data until the limitation periods expire (usually three years after the end of the contract). Where Stripe, PayPal or Klarna process data outside the EU, this is done on the basis of the EU-US Data Privacy Framework or EU standard contractual clauses.

7a. Images and scripts

We load some images from Unsplash, program libraries from cdnjs (Cloudflare) and, for the coach, the maths worksheet and the quiz, from jsDelivr. For technical reasons, your IP address is transmitted to these providers (Art. 6(1)(f) GDPR).

8. Fonts (hosted locally)

This website uses the fonts “Bricolage Grotesque” and “Manrope”. The font files are stored locally on our server; no connection to Google or other font providers is established when the page loads.

9. Cookies and local storage

This website does not use tracking or marketing cookies. In your browser’s local storage, we only store what is technically necessary for signing in to the coach (sign-in key, last email address used) and, for the free trial, the device identifier “lernup_geraet”; the same identifier is also stored in the cookie “lu_g” (see section 6). The legal basis is § 25(2) no. 2 TDDDG.

10. Your rights

You have the right of access (Art. 15), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20) and objection (Art. 21 GDPR). You can withdraw any consent given at any time. You also have the right to lodge a complaint with a data protection supervisory authority.
